These Terms of Use govern your access to and use of WeDriveYouUnhappy.com, including its pages, user accounts, submission forms, documents, photographs, videos, communications, resolution-contact features, and related services.

In these Terms, “Site,” “we,” “us,” and “our” refer to WeDriveYouUnhappy.com and its Site Operator. “You” and “user” refer to anyone who visits, accesses, registers for, submits information to, or otherwise uses the Site.
By accessing or using the Site, creating an account, or submitting content, you agree to these Terms. If you do not agree, do not use the Site.
1. Purpose of the Site
WeDriveYouUnhappy.com is an information and publishing platform where consumers may document vehicle-related and other consumer experiences, submit supporting evidence, and present unresolved issues for possible review and publication.
The Site may publish information concerning:
- Vehicle purchases and sales.
- Dealership conduct.
- Vehicle repairs and inspections.
- Warranties and service contracts.
- Financing and lending.
- Insurance claims.
- Transportation expenses and vehicle downtime.
- Customer-service interactions.
- Other consumer transactions or disputes accepted by the Site.
The Site may also publish company responses, public records, supporting documents, editorial commentary, corrections, updates, disputed-fact notices, verification labels, and information concerning resolutions.
2. We Are an Information and Publishing Company
The Site and its operator provide information, publishing, documentation, and communication services only.
We are not:
- A law firm or legal referral service.
- Your attorney, legal representative, agent, or fiduciary.
- A government agency, regulator, court, or arbitration service.
- An insurance company, claims adjuster, public adjuster, or insurance adviser.
- A vehicle dealer, manufacturer, inspection service, or repair facility.
- A lender, credit bureau, debt collector, or consumer-reporting agency.
- A settlement company or professional negotiation service.
- A substitute for qualified legal, financial, mechanical, tax, insurance, or other professional advice.
Publication of an issue does not establish that a law was violated, that a crime occurred, that a person or company is legally responsible, or that the contributor is entitled to payment or another remedy.
3. No Attorney-Client or Professional Relationship
Using the Site, submitting a story, communicating with the Site administrator, or receiving a response does not create an attorney-client relationship or any other professional, agency, fiduciary, or representative relationship.
The Site does not represent contributors in claims or negotiations unless a separate written agreement expressly states otherwise.
Information provided through the Site is general information and should not be treated as legal advice for a particular situation.
4. Legal Deadlines Continue to Run
Using the Site does not:
- File a lawsuit or administrative complaint.
- Provide formal legal notice to another party.
- Preserve a statute of limitations.
- Extend a warranty, appeal, contractual, or claim deadline.
- Satisfy an insurance notice requirement.
- Preserve evidence controlled by another person.
- Replace a demand letter, preservation notice, government filing, or court filing.
You are responsible for determining and protecting your own legal rights and deadlines.
5. Eligibility
You must be at least 18 years old to create an account or submit content.
A parent or legal guardian may submit information concerning a minor when legally authorized to do so, but unnecessary identifying information about minors must not be submitted.
By using the Site, you represent that you have the legal capacity to agree to these Terms.
6. User Accounts and Authentication
Certain Site features may require an account.
Users may authenticate through a link or code sent to an email address or telephone number. You are responsible for:
- Providing accurate contact information.
- Maintaining control of your email and telephone accounts.
- Protecting authentication links and codes.
- Promptly reporting suspected unauthorized access.
- Keeping your account information current.
- Ensuring that anyone using your account is authorized to do so.
You may not share authentication links or codes with unauthorized persons.
We may require additional verification, suspend login access, invalidate authentication links, or introduce additional security controls when reasonably necessary.
7. User Roles and Permissions
The Site may assign account roles, including:
- Site administrator.
- Administrator.
- Submitter.
- Fact checker.
- Other roles created for Site operations.
Roles determine what information and functions a user may access.
Possession of a role does not grant ownership of Site data or unrestricted authority over another user’s submission. Users may access only the records and functions authorized for their accounts.
Site administrators may review, edit, reassign, verify, unverify, publish, restrict, or remove records as necessary to operate and protect the Site.
8. Pending Review and Publication
User submissions are not automatically published.
Newly submitted content may be marked as pending review and withheld from public display until it is reviewed and approved.
Submission does not guarantee that content will be:
- Reviewed within a particular period.
- Verified.
- Published.
- Published in its entirety.
- Kept online permanently.
- Presented using the contributor’s requested title, wording, layout, or classification.
We retain editorial discretion over whether, when, where, and how content appears on the Site.
9. User Ownership of Submitted Content
You retain the copyright and other ownership rights you legally possess in original content you submit.
The Site does not claim ownership of your original story, photographs, video recordings, audio recordings, or other original works merely because you submit them.
You may continue to use, publish, share, or license your original content elsewhere.
Your ownership is subject to:
- Rights belonging to other people.
- Existing licenses or contractual restrictions.
- Privacy and publicity rights.
- Copyright limitations and exceptions.
- Court orders and applicable law.
- The license you grant to the Site under these Terms.
10. License Granted to the Site
By submitting content, you grant the Site Operator a nonexclusive, worldwide, royalty-free license to:
- Receive, store, copy, and process the content.
- Review and investigate the submission.
- Reproduce, publish, display, distribute, and communicate the content.
- Format, organize, crop, resize, caption, transcribe, translate, excerpt, or redact it.
- Correct spelling, grammar, punctuation, formatting, and obvious typographical errors.
- Combine it with timelines, responses, public records, supporting documents, verification notes, and editorial context.
- Use reasonable excerpts to identify or promote the published story.
- Provide the content to technology, hosting, security, legal, administrative, verification, and other service providers who assist with Site operations.
- Preserve copies for backups, security, legal compliance, evidence preservation, dispute documentation, and archival records.
This license applies only to rights you own or are legally authorized to grant.
The Site will not intentionally alter the material meaning of your personal account without identifying the change as editorial content or discussing the change with you.
No royalty, publication fee, licensing payment, or other compensation is owed unless the Site Operator agrees otherwise in a separate signed writing.
11. Contributor Representations
By submitting content, you represent and warrant that:
- The submission concerns your own experience or information you are authorized to provide.
- Your factual statements are true and accurate to the best of your knowledge.
- You have a reasonable factual basis for the allegations you make.
- You have not knowingly submitted false, fabricated, deceptively altered, or materially misleading information.
- You have not deliberately omitted material facts to create a false impression.
- You have clearly distinguished facts from opinions, estimates, suspicions, and statements made by others.
- You have accurately attributed statements made by other people.
- You own the submitted content or have sufficient permission to submit it.
- Your submission does not knowingly violate another person’s copyright, privacy, publicity, confidentiality, contractual, or other legal rights.
- You will notify the Site if you discover a material error in your submission.
- You have disclosed any payment, incentive, employment, business relationship, or other material connection that could affect the credibility of your submission.
You may not present rumors, speculation, generated material, or social-media claims as facts you personally verified.
12. Supporting Documents and Evidence
You should provide supporting documents when available.
Supporting materials may include:
- Purchase and financing agreements.
- Repair orders and invoices.
- Estimates and inspection reports.
- Warranty and service-contract records.
- Emails, letters, text messages, and chat transcripts.
- Photographs, videos, and audio recordings.
- Insurance documents.
- Police and government records.
- Court records.
- Payment records.
- Witness information.
- Records showing downtime, transportation expenses, lost income, or other claimed damages.
You must retain your original records.
The Site is not an evidence-storage service and does not guarantee that submitted files will remain available permanently.
Do not alter documents or media in a way that conceals or changes their original meaning. Privacy redactions are permitted, but we may request an unredacted copy for nonpublic verification.
13. No Confidentiality
Information submitted to the Site is not confidential.
Do not submit privileged, confidential, proprietary, or legally protected information unless you have the authority to disclose it and understand the consequences.
Submitted content may be reviewed by:
- Site administrators.
- Fact checkers.
- Contractors and service providers.
- Hosting and technology providers.
- Legal advisers.
- Security personnel.
- Other persons reasonably involved in reviewing or operating the Site.
Relevant information may be shared with a person or company discussed in a submission to request verification, comment, correction, or a response.
We may also disclose information when reasonably necessary to:
- Comply with legal process.
- Investigate fraud, abuse, or security incidents.
- Respond to a copyright, privacy, or legal complaint.
- Protect the Site, its users, or another person.
- Enforce these Terms.
- Preserve or defend legal rights.
14. Sensitive and Personal Information
Do not submit unnecessary sensitive information.
Unless specifically requested through a secure process, do not submit:
- Social Security numbers.
- Complete payment-card or bank-account numbers.
- Passwords, authentication codes, or security answers.
- Complete driver’s-license numbers.
- Full dates of birth.
- Unrelated medical records.
- Unnecessary information concerning children.
- Intimate images.
- Personal addresses of uninvolved private individuals.
- Information restricted by a court order or sealing order.
You are responsible for reviewing and redacting your documents before submission.
Although the Site may make additional redactions, we do not guarantee that every sensitive detail will be identified before publication.
15. Public Identity Options
The Site may allow contributors to request publication under:
- Their full name.
- Their first name and last initial.
- A display name.
- An anonymous public label.
The Site may still require the contributor’s true identity and contact information for private verification and administration.
We cannot guarantee anonymity. A contributor may be identifiable from the facts, documents, photographs, vehicle information, public records, legal filings, or responses of other parties.
16. Editorial Review and Verification
The Site may review, verify, organize, edit, label, or supplement submitted content.
The Site may:
- Ask for additional information.
- Verify dates, amounts, communications, records, and identities.
- Contact people or businesses discussed in a submission.
- Publish a response, denial, or explanation from another party.
- Publish documents that support, contradict, or qualify a claim.
- Mark a fact as pending, verified, partially verified, unverified, disputed, corrected, resolved, public, or private.
- Divide a story into multiple issues or facts.
- Link related vehicles, transactions, people, businesses, or events.
- Add editorial summaries, headlines, timelines, or explanatory material.
- Redact information.
- Delay or decline publication.
- Restrict or remove content.
A verification label means only that the Site completed the review described with that label. It is not a judicial finding or guarantee of complete accuracy.
17. Responses, Corrections, and Disputes
People and businesses discussed on the Site may submit:
- A response.
- A denial.
- A factual correction.
- Supporting documentation.
- An explanation.
- Information showing that an issue has been resolved.
The Site may publish responses and contradictory information alongside the original submission.
We may correct content without removing the historical record. Material corrections may remain visible so readers can understand what changed.
A disagreement does not automatically require removal. The Site may retain disputed content with appropriate context or labels.
18. “Settle This and I Go Away” Feature
A published issue may include a button or contact feature labeled “Settle This and I Go Away.”
This feature provides a communication channel through which an involved person, company, insurer, attorney, or authorized representative may contact the owner of a specific issue about a possible resolution.
When this feature is used:
- The message may be sent to the user who owns the issue.
- The Site administrator may receive a blind copy for moderation, documentation, security, and recordkeeping.
- Messages concerning an issue owned by the Site administrator may be delivered directly to the Site administrator.
- The issue number, title, URL, sender information, organization, and submission time may be recorded.
- The Site may retain the message and related records.
The button is not:
- An offer to sell silence.
- A demand for payment.
- A promise to remove truthful content in exchange for money.
- An agreement to conceal a matter from regulators, courts, insurers, or law enforcement.
- An acceptance of any settlement proposal.
- A waiver or release.
- Proof that the sender or recipient has authority to settle.
The phrase means that the issue owner is willing to receive a good-faith proposal intended to resolve the underlying issue.
Any settlement must be separately negotiated and accepted in writing by the actual parties.
The Site Operator is not a party to a contributor’s settlement unless the Site Operator signs a separate written agreement in its own capacity.
A resolution may be documented publicly. The Site may preserve the original issue, relevant responses, corrections, and resolution history rather than deleting the record.
19. Prohibited Conduct and Content
You may not use the Site to:
- Submit information you know is materially false.
- Fabricate a consumer experience.
- Impersonate another person or organization.
- Submit deceptively altered documents, images, audio, or video.
- Make unlawful threats.
- Demand money through threats of violence, criminal conduct, or knowingly false accusations.
- Harass, stalk, intimidate, or dox another person.
- Publish unnecessary private identifying information.
- Submit intimate images without lawful consent.
- Exploit, identify, or endanger a child.
- Violate copyright, trademark, privacy, publicity, trade-secret, or other legal rights.
- Disclose information prohibited by a valid court order or legal duty.
- Introduce malware, malicious code, or harmful files.
- Attempt unauthorized access to the Site or another user’s account.
- Scrape, probe, overload, disrupt, or interfere with the Site.
- Circumvent access controls or role restrictions.
- Use automated systems to create accounts or submit content without written permission.
- Manipulate verification, voting, ranking, or review systems.
- Retaliate against another person for making a lawful report or response.
- Use the Site for unlawful discrimination or unlawful conduct.
- Submit paid, incentivized, or conflicted content without disclosing the material relationship.
We may reject, restrict, preserve, report, or remove content that appears to violate these Terms or applicable law.
20. Copyright and Other Intellectual Property
The Site’s original design, branding, software, databases, organization, editorial text, graphics, and other Site-created materials are owned by or licensed to the Site Operator.
Except as permitted by law, you may not copy, reproduce, republish, distribute, sell, or exploit Site-owned material without written permission.
User-submitted content remains subject to the rights of its contributor and any other applicable rights holder.

21. Third-Party Websites and Services
The Site may link to third-party websites, records, businesses, government agencies, social-media services, payment providers, mapping services, or other external resources.
We do not control those services and are not responsible for:
- Their availability.
- Their security.
- Their privacy practices.
- Their content.
- Their accuracy.
- Their products or services.
- Transactions conducted through them.
A link does not necessarily mean that the Site endorses or agrees with the linked source.
22. No Guarantee of Outcomes
We do not guarantee that:
- A submission will be published.
- Published content will attract attention.
- A person or company will respond.
- Publication will produce a refund, repair, replacement, settlement, or other remedy.
- A contributor’s claims will be accepted by a court, regulator, insurer, or other party.
- Uploaded evidence will establish legal liability.
- Every factual error will be discovered.
- The Site will be uninterrupted, secure, or error-free.
- Content will remain available indefinitely.
- Search engines or third parties will remove cached or copied material.
23. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and all content and services are provided “as is” and “as available.”
The Site Operator disclaims all express and implied warranties, including warranties of:
- Accuracy.
- Completeness.
- Reliability.
- Availability.
- Merchantability.
- Fitness for a particular purpose.
- Title.
- Noninfringement.
- Security.
- Results.
We do not warrant that the Site will be free from errors, outages, viruses, unauthorized access, data loss, or other harmful conditions.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
24. Limitation of Liability
To the fullest extent permitted by law, the Site Operator and its owners, officers, employees, administrators, contractors, service providers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or connected with:
- Your use or inability to use the Site.
- Publication or nonpublication of content.
- Another user’s statements or conduct.
- Loss of data or evidence.
- Loss of profits, income, reputation, opportunity, or business.
- Third-party claims or responses.
- Unauthorized account access.
- Reliance on Site information.
- Negotiations or settlements conducted through a Site communication feature.
To the fullest extent permitted by law, the total liability of the Site Operator for claims arising from the Site will not exceed the greater of:
- The amount you paid directly to the Site Operator for the applicable service during the twelve months before the event giving rise to the claim; or
- One hundred dollars.
These limitations do not apply where liability cannot lawfully be limited.
25. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Site Operator and its owners, officers, employees, administrators, contractors, service providers, and agents from third-party claims, liabilities, losses, damages, judgments, costs, and reasonable legal expenses arising from:
- Content you submitted.
- Your breach of these Terms.
- Your violation of another person’s rights.
- Your unlawful use of the Site.
- A materially false or misleading statement you knowingly provided.
- Documents or media you submitted without legal authority.
This obligation does not apply to claims caused solely by the Site Operator’s own unlawful conduct or a material alteration made solely by the Site Operator that changed the meaning of your submission.
26. Account Suspension and Termination
We may suspend, restrict, or terminate an account or access to the Site when reasonably necessary to:
- Enforce these Terms.
- Investigate suspected misconduct.
- Protect users or the Site.
- Respond to legal process.
- Address security risks.
- Prevent fraud or abuse.
- Manage repeated copyright infringement.
- Protect the integrity of published records.
Termination of an account does not automatically require removal of previously published content.
Sections concerning ownership, licenses, confidentiality, record preservation, disclaimers, liability, indemnification, disputes, and other provisions that logically should continue will survive termination.
27. Preservation of Records
The Site may retain records concerning:
- Account registration and authentication.
- Submitted content.
- Original and edited versions.
- Publication history.
- Verification activity.
- Corrections and disputes.
- Responses.
- Resolution communications.
- Security incidents.
- Legal complaints.
- Consent and acceptance records.
Records may be retained after account closure or content removal when reasonably necessary for legal compliance, evidence preservation, backups, fraud prevention, security, dispute documentation, or defense of legal rights.
28. Privacy
Our collection, use, storage, and disclosure of personal information are addressed in the Site’s Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference.
29. Changes to the Site or These Terms
We may modify the Site, its features, and these Terms.
The updated Terms will display a revised effective or last-updated date.
When a change is material, we may provide additional notice through the Site, by email, during login, or through another reasonable method.
Your continued use of the Site after revised Terms take effect constitutes acceptance of the revised Terms. When required, we may ask you to affirmatively accept updated Terms before continuing to use an account or submission feature.
30. Electronic Communications
By providing an email address or telephone number, you consent to receive transactional communications concerning:
- Account authentication.
- Security.
- Submission status.
- Requests for information.
- Responses.
- Corrections.
- Resolution inquiries.
- Policy updates.
- Administrative matters.
Marketing communications, when offered, will be subject to separate consent and opt-out requirements.
You are responsible for maintaining accurate contact information.
31. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules, except where federal law applies or applicable law requires otherwise.
32. Dispute Notice and Venue
Before filing a legal action concerning the Site, you agree to send the Site Operator a written notice describing:
- Your name and contact information.
- The account or content involved.
- The facts supporting the dispute.
- The relief requested.
- Relevant supporting documents.
The parties will have thirty days after receipt of a complete notice to attempt an informal resolution. This provision does not prevent either party from seeking urgent injunctive relief when reasonably necessary.
Unless applicable law requires otherwise, any judicial proceeding concerning these Terms or the Site must be brought in a state or federal court with jurisdiction in Maricopa County, Arizona.

33. Assignment
You may not transfer your account or assign your rights or obligations under these Terms without written permission from the Site Operator.
The Site Operator may assign these Terms in connection with a merger, reorganization, sale of assets, change of control, or transfer of Site operations, subject to applicable privacy obligations.
34. Severability
If a provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
35. No Waiver
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
A waiver is effective only when made in writing by an authorized representative of the Site Operator.
36. Entire Agreement
These Terms, together with the Privacy Policy, Submission and Publication Agreement, Copyright and DMCA Policy, Correction and Removal Policy, and any additional terms presented for a specific service, constitute the agreement between you and the Site Operator concerning use of the Site.
If specific service terms conflict with these Terms, the specific terms control for that service.
